Introductory Provisions
These Terms and Conditions govern the legal relationship between the rental service Mgr. Michal Dušánek – PROPSCOM, registered office: Družstevní 43, 289 01 Dymokury, Company ID No.: 42491924, VAT No.: CZ7007171017 (hereinafter the “Rental Company”), and natural or legal persons (hereinafter the “Lessee”) who rent film props.
Subject of the Lease
The subject of the lease consists of film and stage props (hereinafter the “Props”) specified in the lease agreement or order, which are owned by the Rental Company.
Conclusion of the Agreement
The contractual relationship is established upon the signing of the lease agreement or by confirming the submitted price offer by clicking the “Confirm” button or by a confirmation email. By confirming the order, the Lessee acknowledges that they have read and agree to these Terms and Conditions.
Price and Payment Terms
Prices are contractual. The Lessee undertakes to pay the full rental fee before taking possession of the Props or in accordance with individually agreed terms. The Rental Company is entitled to require a refundable security deposit, the amount of which is specified in the agreement. The Rental Company is also entitled to charge additional fees for above-standard services. The Rental Company is entitled to charge late payment penalties.
Handover and Return of Props
The Props are handed over to the Lessee in functional and clean condition. However, they do not comply with current occupational health and safety requirements, nor with applicable standards relating to electrical inspections or technical certifications. For this reason, they must not be used as functional equipment or in situations requiring safe and real operation. The Rental Company is not liable for any damage arising from the use of the Props outside their intended purpose. Upon return, the Props must be in the same condition as when they were handed over, except for normal wear and tear.
Liability for Damage
The Lessee is liable for any damage, destruction, or loss of the Props. In the event of damage, the Lessee is obliged to cover the cost of repair or the purchase price of a new replacement prop. Further details are specified in Article 9 of the Agreement, Compensation for Damage to Exceptional Items.
Prohibition of Modifications and Subletting
Without the Rental Company’s written consent, it is prohibited to modify, disassemble, or sublease the Props to third parties.
Handling of Props of a Specific Nature
The Lessee undertakes to handle props of a specific nature—particularly those bearing historical symbols, insignia, or markings whose use is restricted or prohibited by law (e.g., symbols of Nazi Germany or the former socialist regime)—strictly in accordance with the applicable laws of the Czech Republic. Such props may be used exclusively for film, theatre, or similar artistic purposes, and only in a manner that does not promote or trivialize totalitarian ideologies.
Copyright Provisions
The rented props are intended exclusively for film, photographic, theatrical, and other creative purposes. The Rental Company does not grant the Lessee any copyright or licence to any original designs, creative elements, or artistic solutions that may form part of the props. The props serve solely as tangible objects and not as copyrighted works within the meaning of copyright law.
The Lessee is entitled to use the props to:
- use them within film or photographic production,
- display them in the final audiovisual work,
- publish the work in which the props are depicted.
The Lessee is not entitled to:
- use them outside the scope of permitted film or photographic production,
- display them in the final audiovisual work,
- publish any work in which the props are depicted.
Prohibition of Taking Photographs
When visiting the Rental Company’s premises, it is prohibited to take photographs, video recordings, or any other visual recordings of the props, storage areas, or other equipment that could—without the prior written consent of the Rental Company—be used for any audiovisual production, post-production, digital creation, or commercial purposes.
Tento zákaz zahrnuje zejména:
- taking photographs of the props for the purpose of their digital processing,
- documenting the premises or goods for subsequent use in film, advertising, video games, or other visual projects,
- creating source materials for the development of 3D models, digital textures, or concept designs.
Exceptions are possible only on the basis of the Rental Company’s explicit prior consent, preferably given in written form. Any breach of this provision is considered a serious violation of the rules and may constitute grounds for terminating the cooperation and for claiming damages or a contractual penalty.
Insurance and Risks
The Lessee may be required to provide proof of insurance covering the Props against damage, loss, or theft. If such insurance is not provided, the rental may be refused or a higher security deposit may be required.
Compensation for Damage to Exceptional Items
In the event of destruction, loss, or irreparable damage to an exceptional item with high artistic, historical, or collectible value that cannot be replaced with an identical piece, the Rental Company has the right to demand compensation from the Lessee in the amount of the current market value of a comparable work or item.
The market value shall be determined on the basis of:
- available price offers for comparable items,
- a professional assessment or expert appraisal, if necessary,
- the current conditions of the collectors’ or art market.
The costs of any expert appraisals shall be borne by the Lessee if their preparation is required to determine the amount of the damage.
Withdrawal from the Agreement
Either party is entitled to withdraw from the agreement in the event of a material breach of contractual obligations. The withdrawal must be made in writing.
Personal Data Protection
The Rental Company processes personal data in accordance with the GDPR and Act No. 110/2019 Coll., on Personal Data Processing.
Final Provisions
These Terms and Conditions are governed by the laws of the Czech Republic. Any disputes arising from these Terms and Conditions shall be resolved by the court having subject-matter and territorial jurisdiction. Effective as of: 1 January 2025.
Contractual Terms
Contractual terms are agreed with each client individually, depending on the scope and duration of the cooperation.
